Why NJ is different

New Jersey uses the ABC Test for unemployment insurance classification — one of the strictest standards in the country. Under it, a worker is presumed to be an employee unless you can prove all three of these:

  1. A — Free from your control and direction in performing the work.
  2. B — Work is outside your usual course of business, or performed outside your place of business.
  3. C — Independently established in that trade, occupation, or business.

Failing any one prong means the worker is legally an employee for NJ UI purposes.
